Family Termination of Assistance and Tenancy

The Hialeah Housing Authority may terminate a tenant's assistance due to any of the following violations as defined in 24 CFR 982.552, and 982.551. When assistance terminates, the HAP contract terminates, payment to owner stops and notification is sent to the owner.

  1. Owner eviction.
  2. Failure to provide required documentation
  3. Any household member has violated the family's obligation not to engage in drug­ related criminal activity
  4. Any household member has violated the family's obligation not to engage in violent criminal activity
  5. Any household member's abuse or pattern of abuse of alcohol that may threaten the health, safety, or right to peaceful enjoyment of the premises by other residents
  6. Failure of students to meet ongoing eligibility requirements
  7. Any family member has committed fraud, bribery or any other corrupt or criminal act in connection with any Federal Housing Program
  8. The family currently owes rent or other amounts for any HA in connection with the Housing Choice Voucher or any other Federal Housing Program
  9. The family has breached the terms of a repayment agreement entered into with the PHA
  10. A household member is subject to a lifetime registration requirement under a state sex offender registration program
  11. The family allows individuals other than those authorized by the housing authority to reside in the subsidized unit.  The family must request HA approval to remove or add any other family member as an occupant of the unit
  12. The family fails to cooperate in child support enforcement efforts
  13. The family violates any provision of the lease. The family may not commit any serious or repeated violations of the lease
  14. The family moves without authorization, abandons unit.
  15. The family fails to provide information necessary for the HA to determine their eligibility, rent, or status
  16. The family subleases, let, assigns or transfers the unit
  17. Any adult family member fails to sign and submit consent forms for obtaining information in accordance with 24 CFR Part 760 and 813.
  18. A family member has engaged in or threatened abusive or violent behavior towards HA personnel.
  19. The family has failed to supply true and complete information
  20. Any family member receives Section 8 assistance while receiving another housing subsidy for the same unit or a different unit under any other Federal State or local housing assistance program
  21. Insufficient Funding.
  22. Family no longer requires assistance. If the amount of HAP provided by the HHA drops to zero and remains at zero for 180 consecutive calendar days the family's assistance terminates automatically.
